Biden DOJ Fighting To Bring Back Mask Mandates

President Joe Biden’s Department of Justice (DOJ) is trying to reinstate mask mandates nationwide by fighting to reverse a court decision that ended the tyrannical edict.

The DOJ is reportedly hoping to reinstate the mask mandates so that they once again have the power to force individuals to wear masks on public transportation, including planes. The initial rule — implemented by the Centers for Disease Control and Prevention (CDC) on January 29, 2021 — required everyone two years old and older to wear masks while in airports and on airplanes, and provided very few exceptions.

U.S. District Judge Kathryn Kimball Mizelle of the Middle District of Florida ruled in April 2022 that the mask mandate was unlawful — concluding that the CDC was overstepping its authority when it issued the directive.

The lawsuit that led to the ruling argued that the Biden administration’s mask mandate “violated the Administrative Procedure Act (APA) on three separate grounds: First, that issuing the order is beyond CDC’s statutory authority granted by Congress in 42 U.S.C. § 264a. Second, that the CDC’s action was really a rule (i.e., a regulation) rather than an order, and therefore had to go through a process of public notice and opportunity for public comment before taking effect. And third, that it violates the APA because it is ‘arbitrary and capricious,’ meaning that it was not the result of reasoned decision-making,” according to reporting from Breitbart News at the time.

In her ruling, the judge wrote: “The government purports to discover this unheralded power to regulate how individuals appear and behave in public in a long-extant statute—one over seventy years old. This history suggests that the power the government sees in § 264(a) is a mirage.”

“The only reason the Mandate cites is the public health emergency,” Mizelle added, concluding that “a limited remedy would be no remedy at all,” which ultimately meant that the mandate was unlawful.

“Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the Court declares unlawful and vacates the Mask Mandate,” the judge said, granting freedom to millions of travelers.

However, the DOJ almost immediately announced its intention to appeal the ruling — requesting that the U.S. Court of Appeals for the Eleventh Circuit reinstate the mandate.

The three-judge panel on the appeals court recently heard arguments in the DOJ’s appeal. Reuters reported that “much of the arguments in the appeal focus on the CDC’s decision to put in place the requirements immediately rather than give the public a chance to comment on the mandate.”

Justice Department lawyer Brian Springer claimed that the mask mandate was crucial “to prevent the possible infections and deaths that could result if people didn’t do the simple thing of just putting on a mask while they were traveling.”

Of course, Americans who are still scared of getting sick are free to wear masks willingly, despite the fact that masks are not very effective at preventing the transmission of the virus, as studies have shown and Dr. Anthony Fauci admitted.

The Biden administration’s extended mask mandate is yet another example of a broken promise from the president, who originally claimed that the mandate would only last for “just” 100 days prior to taking office — calling it a “patriotic act.” This follows Biden’s lie about not pushing mandatory vaccines, a promise he broke that was only stopped because of a final ruling from the Supreme Court.
