Reps. Chip Roy and Andy Biggs are demanding an investigation into a case that has gripped pro-life advocates since 2022. According to their joint letter, the remains of five late-term infants—dubbed the “DC Five”—were discovered by pro-life activists outside the Washington Surgi-Clinic, operated by Dr. Cesare Santangelo. Yet, instead of probing the clinic for potential violations of federal law, the Biden administration focused on prosecuting the activists who made the discovery.
As reported by The Daily Wire, the Department of Justice has shown little interest in determining whether the Partial-Birth Abortion Ban Act or the Born-Alive Infants Protection Act were violated. These federal laws are designed to prevent procedures where a child is partially delivered before being killed, or to protect those who survive abortion attempts.

Evidence of Illegal Abortion Practices
The condition of the infants’ remains, according to those who found them, suggested possible crimes had occurred. Injuries observed by the activists—including fully intact bodies—could point to illegal late-term abortions or infanticide. Despite the grave implications, the Biden DOJ and D.C. Mayor Muriel Bowser’s office reportedly failed to pursue any investigation.
“Serious questions remain surrounding the deaths of these children,” the congressmen wrote, as cited by The Daily Wire. Their concern is echoed by many in the pro-life movement who accuse federal agencies of willful neglect and political bias in choosing which laws to enforce.
Political Targeting While Ignoring Potential Crimes
The outrage deepens when viewed alongside the Biden administration’s aggressive prosecution of pro-life demonstrators under the FACE Act, a federal law intended to protect access to abortion clinics. While those uncovering potentially illegal conduct face legal consequences, abortion providers who may have violated federal law remain untouched.
“Very strong evidence suggests the ‘DC Five’ unborn children were killed within miles of our U.S. Capitol building,” the lawmakers stated in their letter, highlighting the proximity of this alleged atrocity to the heart of federal power.
Roy and Biggs are giving FBI Director Kash Patel until April 29 to respond with a full review and to schedule a briefing. In their words: “I am confident the current leadership at the DOJ and FBI will take action to defend life in our nation’s capital and to ensure that these five babies receive justice.”
