Texas has taken legal action against the NCAA, accusing the organization of misleading consumers by promoting “women’s sports” in which men are allowed to compete. The lawsuit, filed by Texas Attorney General Ken Paxton, demands that the NCAA either ban transgender women from competing in women’s athletics or stop labeling these events as “women’s sports.”

The lawsuit claims that the NCAA has been engaging in false advertising by misrepresenting the nature of women’s sports. Texas argues that the term “woman” has always referred to an “adult human female” and that permitting men to compete against women creates unfair competition. The state further argues that this deprives women of opportunities to win titles, records, and scholarships.

The complaint also points to the growing popularity of women’s athletics, such as women’s basketball and volleyball, noting that the NCAA has seen a significant rise in consumer demand for these events. Texas argues that fans who purchase tickets or merchandise for women’s sports are often misled when they discover that men are competing in these events.

Finally, the lawsuit highlights the safety concerns surrounding transgender women competing in women’s sports. The suit cites the physical advantages men have over women, even with hormone suppression, and references incidents where women have been injured by male athletes in women’s competitions.
